Iβm a freelance artist, Tomyummart.
My Terms of Use cover and regulate the use of all my artistic services, including commissioned artworks, adoptable designs, and any art made by me.
By purchasing a commission, adoptable, or receiving any of my artwork (including free art), you automatically agree to my Terms of Use.πΈπ₯ππππ§π¦ ππ‘π π’πͺπ‘ππ₯π¦πππ£β¦ I retain the rights to every arts I produce.β¦ You are allowed to reupload my art to other sites only with proper credit.β¦ You are not allowed to use my art for AI or NFT.β¦ The client recieves a personal license to use my artwork for personal or agreed commercial purposes, but does not own the artwork itself.The authorshop and copyright of all artworks remait with me, tomyummart, unless it's stated otherwise.β¦ Commercial usage must be discussed and paid for separately.-For adoptables, each sale post clearly states whether commercial rights are included or if they must be purchased additionally.
If commercial rights were not purchased or included by default, the buyer may only use my work for personal, non-commercial purposes.-Even without commercial rights, the buyer may resell my design to another private individual for personal use, for a price not higher than the total amount paid (including the base adopt price and any additional commissioned artwork of the same character).
-If the next owner wishes to use my artwork for commercial purposes, they must contact me (Tomyummart) to discuss and purchase the appropriate license.β¦ You don't have right to edit my art without my permission.β¦ If you have created a character similar to my design, please do not sell them separately or immediately indicate that you have a similar design - so that neither you nor I have any problems.β¦ If I find out that my design was purchased solely for profit-making purposes, I reserve the right to blacklist the buyer and refuse to provide them with any further services or products.πΈπ£ππ¬π ππ‘π§β¦ I usually work with full upfront payment.
The work will only begin after the full amount (100%) has been paid.β¦ All prices are listed in EUR (β¬).β¦ Payments can be made through the following methods:
- IBAN bank transfer
- PayPal transfer
- PayPal invoice
- Or via trusted third-party platforms such as VGen or Ko-fiπΈπ₯πππ¨π‘π π£π’ππππ¬
A refund can be issued when:
π.The client's commission has been terminated by the artist.
π.The customer waited too long for his order (more than 3 months)
(the refunded amount will depend on the stage at which the artist was.)
π.If the client experiences an unexpected life situation where they no longer need the commission. I still reserve the right to refuse a refund.-You do not have the right to use any of my work created for you if the full amount has been returned.β¦ Once work has started, refunds are only possible for the 3 reasons listed above.β¦ Refunds will be issued after I have discussed the final refund amount with the client.β¦ The refund period may take up to a maximum of one and a half months.πΈπͺπ’π₯ππππ’πͺ ππ‘π π£π₯π’πππ¦π¦β¦ The client will receive an initial sketch for approval.
(This may vary depending on the type of commission β details are usually stated in each commission offer.)-After approval, the client may request WIPs (Work In Progress) updates if available.
Once the sketch is approved, the client will receive the final completed artwork.β¦ After the sketch is approved, minor edits (such as small detail or color adjustments) can still be made to the final piece.
However, major changes β such as completely redesigning clothing, hairstyle, or pose β may require an additional fee.
I also reserve the right to charge extra fee if too many revision requests are made. (The client will be notified in advance when further edits will require an additional charge.)β¦ If the client does not respond within 14 days, I reserve the right to reach out through other platforms using the contact information provided.
If there is no reply within 7 additional days, the commission can be cancelled without a refund.β¦ If I cannot end commission in deadline you will receive an extra art. If I didn't offer it to you, you have the right to ask for extra BEFORE I finish your commission. If I finished your commission and you didn't ask for an extra, then you can't ask for it anymore.β¦ After payment you can ask to receive my TRELLO - To-do list. There you can see estimated dates for your commission, that can be changed or delayed. Dates in Trello are just estimated ones. Please keep this in mind.β¦ You can pay for commission to be completed faster.πΈπ₯πππ¨π¦ππ π’π π¦ππ₯π©πππβ¦ I (Tomyummart) reserve the right to refuse any commission at any time and for any reason, without the need to provide an explanation.β¦ I do not accept commissions involving political, discriminatory, or otherwise prohibited topics.
I also do not accept content featuring guro, extreme violence, or any other form of explicit brutality.
